Second Hand Smoke (SHS) Exposure…

U.S. Surgeon General Richard H. Carmona has issued a report concluding that there is no risk-free level of exposure to secondhand smoke. Nonsmokers exposed to secondhand smoke increase their risk of developing heart disease by 25 to 30 percent and lung cancer by 20 to 30 percent. The report finds that even brief secondhand smoke exposure can cause immediate harm. The report says the only way to protect nonsmokers from the dangerous chemicals in secondhand smoke is to eliminate smoking indoors. The report also finds that exposure to secondhand smoke is a known cause of sudden infant death syndrome (SIDS), respiratory problems, ear infections, and asthma attacks in infants and children (according to Surgeon General Carmona, vice admiral of the U.S. Public Health Service). “The scientific evidence is NOW indisputable: secondhand smoke is not a mere annoyance. It is a serious health hazard that can lead to disease and premature death in children and nonsmoking adults.” Secondhand smoke contains more than 50 cancer-causing chemicals, and is itself a known human carcinogen. Don’t Go Up In Smoke!…

Understand conventionally-grown tobacco that is encased in pipes and that is encased in manufactured cigarettes/cigars is an enemy of a Healthy Heart. Although, many people know that tobacco smoking can cause lung cancer, they often don’t realize that tobacco smoking is a major risk factor for heart disease. Most healthcare providers agree: The first step in fighting heart problems is to quit smoking tobacco. Smoking interferes with many notable functions of the body by; raising blood pressure, lowering the oxygen supply, causing a risk of blood clots, and damaging the arteries. The nicotine, in tobacco smoke, acts as a stimulant that makes the heart beat faster and raises the blood pressure. At the same time, nicotine causes the arteries to shrink up (which interferes with the flow of blood in the body and makes the heart work even harder). Smoking also releases carbon monoxide into the body (which lowers the amount of oxygen in the blood). As a result, the heart has to work harder to supply the oxygen that the body needs. Under these conditions, normal activities can make a person breathless and strenuous activity may become impossible. Smoking tobacco also makes the blood thick and sticky (so it’s easier for clots to form in the arteries) leading to heart attacks or other life-threatening situations. Smoking tobacco can also severely damage blood vessels (by causing fatty deposits to accomplish up in the walls of the arteries). Clogged arteries effect it difficult for the heart to get the oxygen it needs (putting a severe strain on the heart). In severely narrowed arteries, a clot can totally slash off the circulation (a condition that can be fatal). The clear message: Smoking seriously increases a person’s risk for heart attacks, strokes, circulatory diseases in the extremities, chronic lung diseases, and other forms of heart disease. But, this risk factor can be completely controlled. When a person stops smoking tobacco, this same person immediately improves their health and their opportunity for a longer life.

‘Smoking kills’, doctors warned in 1606

The letter, by Dr Eleazar Duncon, was unearthed by library staff at the Royal College of Physicians of Edinburgh (RCPE) as they prepared for an exhibition. A doctor’s letter written more than 400 years ago has revealed medics then were concerned about the dangers of young people smoking. Dr Duncon’s letter, which was published by his employer in 1606, reveals medics were concerned about the issue four centuries ago. The letter concluded that tobacco “is so hurtful and dangerous to youth that it might have the pernicious nation expressed in the name, and that it were as well known by the name of Youths-bane as by the name of tobacco.” The RCPE president commented on the letter and said: “This letter from our library collection provides a fascinating insight into historical medical concerns about the addictive nature of smoking and young people, and shows that this issue has been of concern for over four centuries.”

The Tobacco Control Legal Consortium on what can be done for nonsmokers who reside in multi-unit housing where they are being exposed to secondhand tobacco smoke. Here is what you will read in the updated October 2009 report: Infiltration of Secondhand Smoke into Condominiums, Apartments and Other Multi-Unit Dwellings…

“Landlords and condominium associations may prohibit smoking or refuse to allow smoking for new, and in many cases existing, occupants. There is no judicially recognized “right to smoke” in a multi-unit dwelling, whether the dwelling is privately owned or public housing. Residents of multi-unit dwellings have a variety of common law remedies for stopping secondhand smoke infiltration. A resident of a multi-unit dwelling who can display that secondhand smoke exposure limits a major life activity can exhaust the Federal Fair Housing Act to seek to end the secondhand smoke infiltration. Landlords and condominium associations can prohibit smoking in their leases and governing documents, although they may be able to consume action even without such language.”

Note: Common law remedies include ETS incursion, trespass, intentionally invading another’s interest in land, nuisance, covenant of quiet enjoyment, warranty of habitability, negligence, constructive eviction, intentional infliction of emotional distress and battery, and harassment. Do you know…

There is no such thing as a ‘smoker’ or a ‘non-smoker’? We are all people and some people choose to smoke tobacco while other people choose not to smoke tobacco. Smoking tobacco is not a person’s identity; it’s only one thing of many things that people do or don’t do. Smoking tobacco does not define a person. Let’s display love to the people who smoke tobacco and, many of these same people are good people. It is important to remember that smokers have either reach to the false conclusion that smoking isn’t that bad for them (or other people) or they are unable to control their addiction to nicotine. Either way, they generally do not understand the discomfort, irritation and health problems that their tobacco addiction brings to others. While many nonsmokers become impatient and excited with smokers, nonsmokers must realize that most smokers are victims. The tobacco companies, together forming a billion dollar industry, hires top market researchers, scientists and other professionals to influence the buying habits of potential consumers. Further, they pick on the weakest members of our society. Remember that many smokers began smoking around 13-14 years of age. Many of these naive individuals have lower self-esteem, suffer social problems or arrive from less-stable home environments. Therefore, be firm but view with smokers. Due to their addiction, they have lost track of reality. They wheeze, cough and spit up phlem as they are slowly killing themselves. Shortly after finishing their last cigarette, their body begins demanding another. They no longer taste food as they old to; they cannot run or be athletic as they once could; and in general, they are a slave to this nasty habit.

How Smoking Affects You…

Nonsmokers who live with or around smokers are more likely to earn cancer than other nonsmoking adults. Second-hand smoke can enter a dwelling through windows, gaps in walls, air spaces in light fixtures or through the ventilation systems. As a general rule: If you can smell smoke, you may be exposed to the harmful toxins. If you have asthma, second-hand smoke can make your breathing problems worse. Young children are especially sensitive to second-hand smoke. A baby who is exposed to second-hand smoke is more likely to have lung disease serious enough to need treatment in a hospital dunging the first two years of life. The general health protection language of the regulations, in conjunction with the latest evidence of the harmful eVects of ETS, gives state agencies authority to regulate environmental tobacco smoke incursions among apartments in multi-unit dwellings. This article examines regulatory and common law legal theories available to address the problem of environmental tobacco smoke (ETS) incursion into the homes of non-smoking residents of multi-unit dwellings. Non-smoking residents may exhaust existing state regulations, such as sanitary codes, as a mechanism for legal action to prevent OR limit incursion of ETS into non-smokers’ apartments or condominiums in multiple occupancy residential buildings. The advantage of this strategy is that it employs an administrative system for correction of health violations that is already in place and well-liked. No legislative action is necessary; no unique legal theory need be created. It merely involves an application of existing law and scientific knowledge to specific facts by a Board of Health (the Board). Where the Board decision is appealed to a local court, the court may determine to defer to the administrative body’s judgement in its area of expertise.”

The Registry was created in 2001 in response to the many requests they have received from the public for information about rental units which are free of drifting tobacco smoke. It is unfortunate that in some apartment and condominium buildings, tobacco smoke can drift from one unit into another, or can enter an apartment or condo from halls, stairs, balconies, patios and courtyards. Most apartment residents are aware of the health hazards of secondhand tobacco smoke and wish to be protected from it. However, many apartment owners are not aware that they have the choice to impress all or share of an apartment building or complex as non-smoking. Requiring no smoking in an apartment building reduces maintenance costs, prevents fires, and may result in insurance discounts. The Smoke-free Apartment House Registry offers a free vacancy listing service on their web site to apartment owners who have chosen to assign a total or partial non-smoking policy in their buildings. In buildings of 16 units or more, at least 50% of the adjacent units must be maintained as non-smoking to be included in the Registry. The Smoke-free Apartment House Registry also suggests that balconies, patios, courtyards, enclosed common areas and outdoor common areas where amenities are located (swimming pool, children’s play area) be required to be non-smoking as well. The Smoke-free Apartment House Registry recommends that buildings of 10 units or less be maintained as entirely non smoking.
